ANATHA FESTIVAL

MASTER TICKET HOLDER AGREEMENT, CONDITIONS OF ENTRY, ACKNOWLEDGEMENT OF RISK, MEDIA CONSENT & INDEMNIFICATION

Venue: RécréoParc, Sainte-Catherine, Québec
Festival: Anatha Festival (“Anatha,” the “Festival,” “we,” “us,” or “our”)

 

 

IMPORTANT — PLEASE READ BEFORE PURCHASING

Anatha Festival is an outdoor music, wellness, arts, cultural and community event held at RécréoParc in Sainte-Catherine, Québec.

By purchasing, accepting, possessing or using an Anatha ticket, wristband, credential or admission pass, and/or by entering or remaining within the Festival grounds, the purchaser and attendee (“Participant”) acknowledges that they have been given access to these Conditions, have had an opportunity to review them, and agree to comply with them.

These Conditions are intended to:

  • establish mandatory Festival rules;
  • identify inherent and reasonably foreseeable risks;
  • establish conditions of admission and continued attendance;
  • protect participants, artists, vendors, staff, volunteers, RécréoParc and Festival property;
  • allocate responsibility where legally permitted;
  • obtain appropriate media consent;
  • establish responsibility for a Participant’s own wrongful conduct; and
  • preserve all mandatory rights and obligations imposed by Québec law.

Nothing in this Agreement excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

 

 

1. ACCEPTANCE OF CONDITIONS

By purchasing or using a ticket and attending the Festival, the Participant agrees to comply with:

  1. this Agreement;
  2. Anatha’s published Festival rules;
  3. Anatha’s prohibited-items policy;
  4. applicable RécréoParc rules;
  5. reasonable instructions issued by Anatha personnel;
  6. reasonable instructions issued by RécréoParc personnel;
  7. security and emergency instructions; and
  8. applicable municipal, provincial and federal laws.

Failure to comply may result in:

  • refusal of admission;
  • cancellation or confiscation of a wristband or credential where permitted;
  • removal from the Festival;
  • refusal of re-entry;
  • banning from future Anatha events;
  • financial responsibility for damage caused by the Participant; and/or
  • referral to police or other authorities where appropriate.

 

2. RÉCRÉOPARC RULES FORM PART OF THE CONDITIONS OF ATTENDANCE

Anatha operates on property managed by RécréoParc.

Participants must comply with applicable RécréoParc regulations in addition to Anatha’s Festival rules.

A Participant may not engage in conduct that:

  • violates RécréoParc rules;
  • damages RécréoParc property;
  • interferes with the safe operation of the park;
  • causes Anatha to violate its obligations toward RécréoParc;
  • exposes Anatha to a claim, repair charge, penalty or other loss because of that Participant’s misconduct; or
  • jeopardizes Anatha’s current or future ability to use the venue.

RécréoParc publishes specific rules and operational requirements for its various sectors.

 

 

3. GENERAL ACKNOWLEDGEMENT OF RISK

The Participant understands that attendance at a large outdoor festival involves inherent and reasonably foreseeable risks.

These may include:

  • large crowds;
  • crowd movement;
  • collision with other attendees;
  • slips, trips and falls;
  • uneven or natural terrain;
  • rocks, vegetation and roots;
  • mud and wet surfaces;
  • temporary flooring;
  • temporary structures;
  • tents;
  • stages;
  • cables;
  • electrical equipment;
  • production equipment;
  • heat;
  • sun exposure;
  • rain;
  • wind;
  • thunderstorms;
  • cold;
  • dehydration;
  • fatigue;
  • loud sound;
  • flashing or stroboscopic lighting;
  • lasers or visual effects;
  • smoke, haze or theatrical effects;
  • physical activity;
  • insects;
  • wildlife;
  • food sensitivities or allergies;
  • communicable illness;
  • actions of other attendees or third parties;
  • traffic and transportation delays;
  • proximity to the St. Lawrence River;
  • emergency evacuation;
  • temporary loss of services; and
  • loss, theft or damage to personal belongings.

The Participant acknowledges that no large public outdoor event can eliminate every possible risk.

 

 

4. PARTICIPANT RESPONSIBILITY

Participants must exercise reasonable care for:

  • their own safety;
  • the safety of persons under their supervision;
  • other Participants;
  • Festival property;
  • RécréoParc property;
  • artists and vendors;
  • the surrounding environment; and
  • personal property they bring to the Festival.

Québec law generally requires every person to abide by applicable rules of conduct so as not to cause injury to another.

 

 

5. FORCE MAJEURE

For purposes of these Conditions, a Force Majeure Event means an event outside Anatha’s reasonable control that satisfies the applicable legal requirements of an unforeseeable and irresistible event.

Depending on the circumstances, this may include:

  • extreme or dangerous weather;
  • flooding;
  • fire;
  • natural disaster;
  • governmental order;
  • evacuation order;
  • public-health emergency;
  • major infrastructure failure;
  • interruption of essential utilities;
  • serious security threats;
  • terrorism or credible threats thereof;
  • war or civil disturbance;
  • transportation shutdowns;
  • unexpected loss of legal access to the venue;
  • closure of the venue by authorities;
  • circumstances making the venue unsafe or unusable; or
  • another event meeting the legal requirements of force majeure.

Under the Civil Code of Québec, force majeure is tied to unforeseeable and irresistible events.

In response to such circumstances, Anatha may reasonably:

  • delay opening;

  • alter Festival hours;

  • suspend programming;

  • close particular areas;

  • postpone activities;

  • relocate activities;

  • change the date;

  • change the venue;

  • modify programming;

  • restrict attendance;

  • evacuate all or part of the site; or

  • cancel all or part of the Festival.

Anatha will use reasonable efforts to preserve and deliver the Festival where circumstances allow.

Participants acknowledge that significant costs are committed in advance, including costs relating to:

  • venue;

  • artists;

  • production;

  • stages;

  • sound;

  • lighting;

  • infrastructure;

  • security;

  • medical personnel;

  • insurance;

  • permits;

  • staffing;

  • travel;

  • rentals;

  • marketing;

  • sanitation; and

  • other non-recoverable expenses.

Any refund, credit, postponement or other remedy remains subject to Anatha’s published policy and mandatory applicable law.

 

 

6. VENUE CHANGES

Anatha intends to hold the Festival at the advertised venue.

However, if the original venue becomes unavailable, unsafe, legally inaccessible or operationally unusable because of circumstances outside Anatha’s reasonable control, Anatha may relocate all or part of the Festival where reasonably necessary.

A change of venue does not automatically constitute cancellation where Anatha continues to provide a substantially comparable Festival event, subject to mandatory consumer rights.

 

 

7. ARTISTS, PRESENTERS, WORKSHOPS & PROGRAMMING MAY CHANGE

A Festival ticket grants admission to Anatha Festival as a whole.

It is not a contractual guarantee that any particular:

  • musician;

  • DJ;

  • headliner;

  • artist;

  • presenter;

  • speaker;

  • instructor;

  • facilitator;

  • workshop;

  • vendor; or

  • activity

will appear or take place exactly as advertised.

Artists and programming may be:

  • cancelled;

  • substituted;

  • delayed;

  • shortened;

  • rescheduled;

  • moved to another stage;

  • changed to another time; or

  • otherwise modified.

The cancellation or substitution of one or more artists—including an advertised featured artist—does not, by itself, constitute cancellation of the Festival.

Major Québec event operator evenko similarly advises that performer changes do not necessarily create refund rights.

No refund is automatically payable solely because a particular artist, presenter, vendor or activity changes or does not appear, except where applicable law requires otherwise.

 

 

8. TICKETS & REFUNDS

Unless expressly stated otherwise, Festival ticket purchases are final sale.

The Participant’s personal inability or decision not to attend does not automatically create a right to a refund.

This includes situations involving:

  • personal schedule changes;

  • transportation problems;

  • traffic;

  • drawbridge delays;

  • parking delays;

  • missing a performance;

  • an artist change;

  • programming changes;

  • weather conditions under which the Festival remains operational;

  • dissatisfaction with an individual vendor;

  • inability to attend a particular workshop; or

  • leaving the Festival early.

Anatha may voluntarily offer:

  • refunds;

  • credits;

  • transfers;

  • deferrals; or

  • other accommodations

where it considers doing so appropriate.

Any mandatory consumer rights remain unaffected.

 

 

9. PROGRAMMING CHANGES DO NOT AUTOMATICALLY EQUAL FESTIVAL CANCELLATION

Anatha invests substantially in producing the Festival as an overall experience.

A Participant purchases access to the Festival as a whole rather than to any one individual performer.

Accordingly, changes involving individual artists, workshops, schedules, vendors or activities do not automatically constitute failure to provide the Festival.

 

 

10. PARKING IS A SEPARATE RÉCRÉOPARC SERVICE

Parking at RécréoParc is operated, administered or controlled separately from Anatha where applicable.

RécréoParc publishes separate parking rates and conditions.

Anatha does not guarantee:

  • availability of parking;

  • a particular parking space;

  • proximity to the Festival entrance;

  • parking-lot security;

  • a particular waiting time;

  • traffic flow;

  • vehicle entry times;

  • vehicle exit times; or

  • uninterrupted access to parking.

Participants must comply with RécréoParc parking directions and personnel.

 

 

11. VEHICLES & PERSONAL BELONGINGS

Anatha does not accept custody of vehicles parked at or near RécréoParc.

Participants are responsible for securing their own vehicles.

Participants are strongly advised to:

  • lock all vehicle doors;

  • close windows and sunroofs;

  • activate security systems where available;

  • retain possession of their keys;

  • remove valuables where reasonably possible;

  • place belongings out of plain sight;

  • secure luggage and merchandise; and

  • avoid leaving cash, identification, wallets or electronics visible.

To the extent permitted by law, Anatha is not responsible merely because property is lost, damaged or stolen from an unattended vehicle.

Nothing in this clause removes liability that cannot legally be excluded.

 

 

12. PERSONAL PROPERTY WITHIN THE FESTIVAL

Participants remain responsible for their belongings throughout the Festival.

Particular care should be taken with:

  • phones;

  • wallets;

  • keys;

  • identification;

  • jewelry;

  • cameras;

  • bags;

  • medication; and

  • electronic equipment.

Anatha recommends bringing only reasonably necessary items.

 

 

13. DRAWBRIDGE & MARINE TRAFFIC

Access to RécréoParc may be interrupted by operation of the lift bridge serving St. Lawrence Seaway traffic.

RécréoParc specifically advises visitors to plan for vessel-related bridge closures.

For an upstream vessel, RécréoParc advises that the bridge may be affected approximately 10 minutes before and 10 minutes after the expected passage.

For a downstream vessel, RécréoParc advises planning for approximately 30 minutes before and 10 minutes after the expected passage.

Actual delays may be longer because of:

  • multiple vessels;

  • Festival traffic;

  • accidents;

  • parking operations;

  • road conditions;

  • construction;

  • weather; or

  • other circumstances.

 

 

14. PARTICIPANTS MUST PLAN FOR ARRIVAL DELAYS

Participants are responsible for allowing sufficient travel time.

Anatha does not guarantee that someone arriving in the vicinity of RécréoParc at a particular time will reach:

  • parking;

  • security;

  • a stage;

  • an artist;

  • a workshop; or

  • another activity

by a particular time.

A traffic, bridge, parking or entry delay does not, by itself, create a refund entitlement except where required by law.

 

 

15. ANTI-IDLING & ENVIRONMENTAL RESPONSIBILITY

During prolonged periods when a vehicle is fully stationary, including waiting associated with bridge operation or marine traffic, Participants are requested to turn off their engines whenever safe and practical.

This Anatha environmental policy is intended to:

  • reduce unnecessary fuel consumption;

  • reduce emissions;

  • reduce unnecessary noise; and

  • improve air quality around waiting vehicles.

Participants must obey instructions from traffic personnel, RécréoParc, security, police or other authorized personnel.

No Participant is required to turn off an engine where doing so would create a legitimate safety issue.

 

 

16. SECURITY SCREENING IS A CONDITION OF ENTRY

For the safety of Participants, artists, vendors, staff and the venue, reasonable security screening may be required before entry or re-entry.

Major Québec events commonly subject bags, personal belongings and attendees to screening or searches at entry.

Screening may include, where permitted by law:

  • visual bag inspection;

  • opening bags or containers;

  • inspection of coolers;

  • inspection of purses or backpacks;

  • inspection of belongings;

  • metal detection;

  • ticket or wristband verification;

  • prohibited-item inspection; and

  • other reasonable event-security procedures.

By purchasing a ticket and seeking admission, the Participant consents to reasonable inspection of belongings brought into the Festival.

 

 

17. RIGHT TO DECLINE A SEARCH — CONSEQUENCE OF DECLINING

A Participant may decline to submit belongings to a requested security inspection.

However, security screening is a condition of entry.

Accordingly:

A PARTICIPANT WHO REFUSES REQUIRED SECURITY SCREENING MAY BE REFUSED ENTRY OR RE-ENTRY.

Refusing required screening does not, by itself, create a right to a ticket refund, except where applicable law requires otherwise.

 

 

18. PROHIBITED ITEMS

Participants must not bring prohibited or dangerous items onto Festival grounds.

These may include:

  • firearms;

  • prohibited knives or weapons;

  • explosives;

  • fireworks;

  • pyrotechnics;

  • illegal drugs;

  • unlawfully possessed controlled substances;

  • unauthorized flammable substances;

  • unauthorized flames;

  • dangerous projectiles;

  • unauthorized drones;

  • items prohibited by RécréoParc; and

  • items reasonably determined by security to present a material safety risk.

Anatha may maintain and reasonably update a separate prohibited-items policy.

 

 

19. NO GUARANTEE THAT SECURITY WILL DETECT EVERY PROHIBITED ITEM

Security screening is a risk-management measure.

It does not constitute a guarantee that every prohibited object or unlawful substance will be detected.

Every Participant remains responsible for obeying the rules whether or not an item was identified during screening.

 

 

20. NO INTERFERENCE WITH SECURITY

Participants must not:

  • conceal prohibited items;

  • bypass checkpoints;

  • enter through unauthorized access points;

  • pass objects over fencing;

  • assist another person in avoiding screening;

  • threaten security personnel;

  • obstruct security;

  • falsify credentials; or

  • interfere with emergency operations.

 

 

21. FIRE & OPEN FLAME

NO UNAUTHORIZED FIRE OR OPEN FLAME IS PERMITTED.

Unless expressly authorized in writing by Anatha and, where required, RécréoParc or other appropriate authority, Participants may not:

  • start a campfire;

  • use an unauthorized barbecue;

  • use an unauthorized propane flame;

  • use an open-flame cooking device;

  • light candles with exposed flames;

  • use torches;

  • perform fire spinning;

  • perform fire breathing;

  • use fireworks;

  • use sparklers;

  • use pyrotechnics;

  • burn garbage or wood; or

  • use another unauthorized ignition source.

A verbal statement is not written authorization.

Anatha may immediately terminate any authorized flame activity where weather or safety conditions change.

 

 

22. FIRE SAFETY

Participants must immediately report:

  • unattended flames;

  • suspicious smoke;

  • unauthorized fires;

  • fire near vegetation;

  • unsafe cooking equipment;

  • fireworks;

  • pyrotechnics; or

  • another apparent fire hazard.

Participants may not obstruct:

  • fire lanes;

  • emergency exits;

  • fire extinguishers;

  • fire-suppression equipment; or

  • emergency vehicle access.

 

 

23. ST. LAWRENCE RIVER — NO WATER ACCESS FROM ANATHA GROUNDS

Anatha Festival admission does not include swimming or recreational water access.

Participants must not enter the St. Lawrence River from Anatha-controlled or non-designated shoreline areas.

This includes:

  • swimming;

  • wading;

  • jumping;

  • diving;

  • launching inflatables;

  • entering from the shoreline;

  • crossing barriers;

  • entering closed waterfront areas; or

  • using unauthorized watercraft.

Participants acknowledge that natural waterways may involve risks including:

  • currents;

  • changing depths;

  • underwater obstacles;

  • slippery shoreline;

  • changing conditions;

  • marine traffic; and

  • difficulty conducting rapid rescues.

 

 

24. RÉCRÉOPARC BEACH IS A SEPARATE ACTIVITY

RécréoParc operates a separate designated swimming beach.

The Beach is not included in an Anatha ticket.

RécréoParc operates its Beach under separate admission, hours and rules, and publishes separate 2026 Beach admission rates.

A Participant choosing to use the RécréoParc Beach does so separately through RécréoParc.

Anatha does not:

  • operate the Beach;

  • collect the ordinary Beach admission fee;

  • control Beach capacity;

  • supervise swimming;

  • provide Beach lifeguards; or

  • guarantee Beach access.

The existence of the Beach does not authorize swimming elsewhere.

 

 

25. ILLEGAL DRUGS & CONTROLLED SUBSTANCES

Illegal drug activity is prohibited.

Participants may not:

  • possess illegal drugs;

  • use illegal drugs;

  • sell illegal drugs;

  • distribute illegal drugs;

  • traffic illegal drugs;

  • unlawfully possess controlled substances;

  • misuse prescription medication;

  • possess prescription medication belonging to someone else; or

  • intentionally provide another person with an intoxicating substance without their informed consent.

Serious suspected illegal activity may be referred to law enforcement.

 

 

26. PUBLIC INTOXICATION & DANGEROUS IMPAIRMENT

Excessive intoxication or impairment that creates a material safety concern is prohibited.

Anatha may deny service, seek medical assistance or remove a Participant whose condition reasonably presents a danger.

Examples include:

  • inability to safely walk or stand;

  • loss of consciousness;

  • severe disorientation;

  • aggressive conduct;

  • repeated vomiting accompanied by significant impairment;

  • attempting to enter the river while impaired;

  • interfering with medical personnel;

  • attempting to operate a vehicle while impaired; or

  • behaviour presenting a danger to oneself or others.

 

 

27. ALCOHOL

Alcohol may only be possessed, served or consumed in accordance with:

  • applicable law;

  • Festival permits;

  • authorized areas;

  • Anatha rules; and

  • RécréoParc requirements.

Unauthorized outside alcohol may be prohibited.

Lawful alcohol consumption does not excuse unsafe or unlawful conduct.

 

 

28. CANNABIS, SMOKING & VAPING

Participants must comply with applicable law, RécréoParc rules and Festival restrictions regarding:

  • cannabis;

  • smoking; and

  • vaping.

Legal possession outside the Festival does not automatically create a right to consume a product in every Festival area.

Smoking materials must be fully extinguished and properly discarded.

 

 

29. SEXUAL ASSAULT & SEXUAL VIOLENCE

ANATHA HAS ZERO TOLERANCE FOR SEXUAL VIOLENCE.

The following are prohibited:

  • sexual assault;

  • unwanted sexual touching;

  • sexual harassment;

  • coercion;

  • stalking;

  • intimidation;

  • intentional drugging;

  • non-consensual sexual activity; and

  • other unlawful sexual conduct.

Consent must be voluntary and ongoing.

A person who is unconscious or incapable of meaningful consent must not be subjected to sexual activity.

 

 

30. REPORTING SEXUAL MISCONDUCT

Participants who experience or witness suspected sexual misconduct are encouraged to immediately contact:

  • Festival security;

  • Anatha personnel;

  • medical personnel; or

  • law enforcement/emergency services where appropriate.

Anatha will take reasonable safety reports seriously and may assist with emergency response and investigation.

Anatha cannot guarantee that an independent third party will never engage in unlawful conduct.

The individual committing unlawful conduct remains responsible for their actions.

Nothing in this clause excludes liability that applicable law may impose upon Anatha for Anatha’s own conduct.

 

 

31. VIOLENCE, HARASSMENT & OTHER ILLEGAL CONDUCT

Participants must not engage in:

  • assault;

  • fighting;

  • threats;

  • harassment;

  • theft;

  • vandalism;

  • fraud;

  • deliberate property destruction;

  • weapons offences;

  • intentional contamination;

  • drugging;

  • dangerous conduct; or

  • other unlawful activity.

 

 

32. INDEPENDENT VENDORS

Anatha may provide space to independent third-party businesses, including:

  • food vendors;

  • beverage vendors;

  • artisans;

  • retailers;

  • tattoo providers;

  • body-art providers;

  • wellness practitioners;

  • massage providers;

  • merchants;

  • sponsors; and

  • other independent operators.

Unless expressly identified otherwise, these vendors are not employees or agents of Anatha.

Anatha may establish rules vendors are expected to follow, but each vendor remains responsible for its own:

  • employees;

  • contractors;

  • products;

  • services;

  • permits;

  • licences;

  • insurance;

  • hygiene;

  • sanitation;

  • professional conduct;

  • ingredients;

  • disclosures;

  • representations; and

  • compliance with law.

 

 

33. VENDOR TRANSACTIONS ARE DIRECT TRANSACTIONS

Unless expressly stated otherwise, when a Participant purchases a product or service from an independent vendor, that purchase is directly between:

the Participant and the vendor.

The vendor remains responsible for:

  • the product sold;

  • service delivered;

  • representations made;

  • prices;

  • refunds relating to that transaction;

  • professional standards;

  • ingredients;

  • sanitation;

  • legally required warnings; and

  • applicable warranties.

Providing space to a vendor does not, by itself, make Anatha the manufacturer, preparer or direct seller of that vendor’s product.

 

 

34. VENDORS MUST COMPLY WITH LAW

Vendors are expected to:

  • follow applicable law;

  • follow Anatha rules;

  • follow RécréoParc rules;

  • possess required licences;

  • possess required permits;

  • comply with food-safety laws;

  • accurately identify products where legally required;

  • refrain from selling prohibited substances;

  • refrain from providing undisclosed intoxicants; and

  • maintain appropriate professional standards.

Vendor authorization may be withdrawn for serious violations.

 

 

35. NO UNDISCLOSED OR ILLEGAL SUBSTANCES IN FOOD OR DRINK

INTENTIONAL ADULTERATION OR DRUGGING IS STRICTLY PROHIBITED.

No vendor, Participant or other person may knowingly place an illegal, undisclosed or unauthorized intoxicating or psychoactive substance into another person’s:

  • food;

  • drink;

  • supplement; or

  • other consumable product.

This includes, where unlawful or undisclosed:

  • illegal drugs;

  • hallucinogenic mushrooms or psychoactive mushroom products;

  • cannabis-derived intoxicants;

  • prescription medication;

  • sedatives;

  • stimulants;

  • psychoactive substances; or

  • other intoxicants.

Such conduct is outside any authorization granted by Anatha and may result in immediate removal, vendor shutdown, medical intervention and/or law-enforcement involvement.

 

 

36. ANATHA CANNOT GUARANTEE EVERY VENDOR’S CONDUCT

Although Anatha may impose vendor standards and take reasonable steps concerning vendor selection and compliance, Anatha cannot continuously supervise every action of every independent vendor or employee.

Anatha does not represent that it has:

  • tested every food item;

  • independently verified every ingredient;

  • inspected every individual product immediately before sale;

  • continuously supervised every vendor employee; or

  • guaranteed that no vendor will ever violate law or Festival rules.

Nothing in this provision eliminates liability arising from Anatha’s own legally actionable acts or omissions.

 

 

37. FOOD, ALLERGIES & CROSS-CONTACT

Participants with allergies, intolerances or dietary restrictions should communicate directly with the vendor before consuming food.

Participants should ask about:

  • ingredients;

  • allergens;

  • preparation;

  • cross-contact;

  • dietary restrictions; and

  • unfamiliar ingredients.

The presence of a food vendor at the Festival does not constitute a guarantee that every product is allergen-free.

 

 

38. SUSPECTED FOOD OR DRINK TAMPERING

A Participant who reasonably suspects that a consumable product:

  • has been tampered with;

  • contains an undisclosed intoxicant;

  • has an unexpected psychoactive effect;

  • appears contaminated; or

  • causes unusual symptoms

should immediately:

  1. stop consuming it;

  2. retain the remaining product and packaging where safely possible;

  3. identify the vendor or source;

  4. notify Festival personnel;

  5. seek medical attention where appropriate; and

  6. cooperate with security or authorities where appropriate.

 

 

39. TATTOOS & BODY ART

Tattooing and similar services involve potential risks, including:

  • pain;

  • bleeding;

  • infection;

  • allergic reactions;

  • scarring;

  • permanent alteration of appearance;

  • dissatisfaction;

  • aftercare requirements; and

  • possible correction or removal costs.

A Participant choosing a tattoo or body-art service enters into that transaction with the independent provider.

The provider remains responsible for the professional service it performs.

Participants should independently evaluate the provider, review its consent documents and follow aftercare instructions.

 

 

40. FOOD & WATER PREPARATION BY PARTICIPANTS

Participants are encouraged to plan appropriately for their food and hydration needs.

Where permitted under Festival security rules, Participants may bring appropriate personal food and water.

Independent vendors are also expected to sell food and beverages.

However, Anatha does not guarantee:

  • continuous availability of every food item;

  • that a particular vendor will remain open;

  • that products will not sell out; or

  • that every dietary requirement can be accommodated.

Participants with significant medical or nutritional needs should plan accordingly.

 

 

41. HYDRATION

Participants are strongly encouraged to remain adequately hydrated.

Outdoor Festival conditions can involve:

  • heat;

  • sun;

  • prolonged walking;

  • dancing;

  • physical workshops; and

  • long periods outdoors.

Participants should monitor their own condition and seek medical assistance if symptoms become concerning.

 

 

42. WELLNESS & PHYSICAL ACTIVITIES

Anatha may offer:

  • yoga;

  • breathwork;

  • meditation;

  • dance;

  • mobility;

  • somatic practices;

  • movement activities;

  • fitness activities;

  • sound experiences; and

  • experiential workshops.

Participation is voluntary.

Each Participant is responsible for evaluating whether an activity is appropriate for them.

Participants should stop an activity if they experience:

  • significant pain;

  • severe dizziness;

  • difficulty breathing;

  • chest discomfort;

  • faintness;

  • disorientation; or

  • another concerning symptom.

Festival wellness programming is not a substitute for individualized medical diagnosis or treatment.

 

 

43. MEDICAL ASSISTANCE

A Participant experiencing injury or illness should notify staff, security or medical personnel.

Anatha may facilitate or request:

  • first aid;

  • ambulance services;

  • police assistance;

  • emergency services; or

  • another appropriate response.

Anatha’s assistance does not constitute an admission of responsibility for the underlying incident.

 

 

44. SOUND, LIGHTING & SENSORY EFFECTS

Festival programming may involve:

  • high-volume amplified sound;

  • flashing lights;

  • strobe lighting;

  • moving lighting;

  • lasers;

  • haze;

  • theatrical smoke;

  • crowds; and

  • intense sensory environments.

Participants who are sensitive to these conditions should take appropriate precautions.

Hearing protection is encouraged where appropriate.

 

 

45. MUSICAL & TECHNICAL EQUIPMENT

Participants must not touch, operate, disconnect, move or interfere with unauthorized equipment, including:

  • instruments;

  • microphones;

  • amplifiers;

  • speakers;

  • mixing consoles;

  • DJ equipment;

  • computers;

  • lighting systems;

  • electrical panels;

  • cables;

  • generators;

  • rigging;

  • cameras;

  • recording systems;

  • stage monitors; or

  • production equipment.

 

 

46. STAGES & BACKSTAGE AREAS

Participants may not enter:

  • stages;

  • backstage areas;

  • artist areas;

  • green rooms;

  • production tents;

  • technical areas;

  • equipment storage areas;

  • staff-only areas; or

  • other restricted areas

without express authorization.

This prohibition applies at all times, including overnight.

 

 

47. SECURITY MONITORING OF STAGES & RESTRICTED AREAS

Appropriate areas may be monitored by security personnel and/or cameras for:

  • safety;

  • loss prevention;

  • protection of artists;

  • protection of production equipment; and

  • investigation of incidents,

subject to applicable privacy laws.

Participants should not assume that stages or backstage areas are unsupervised simply because programming has ended.

 

 

48. EQUIPMENT TAMPERING

Unauthorized interference with technical or musical equipment may result in:

  • immediate removal;

  • cancellation of Festival privileges;

  • banning from future Festival events;

  • responsibility for resulting damage; and

  • involvement of police where appropriate.

 

 

49. GIVEAWAYS & ITEMS DISTRIBUTED FROM STAGE

Certain performances or activations may involve lightweight items being distributed or thrown toward an audience.

Examples may include:

  • T-shirts;

  • hats;

  • soft merchandise;

  • inflatable objects;

  • packaged promotional items;

  • produce;

  • cucumbers; or

  • other reasonably lightweight giveaway items.

A Participant remaining in an audience area during such an activity acknowledges that an item may:

  • make contact with them;

  • be dropped;

  • be caught nearby; or

  • cause nearby crowd movement.

Participants must not:

  • fight;

  • shove;

  • climb;

  • aggressively grab another person; or

  • create a dangerous situation

to obtain a giveaway.

Anatha may immediately stop a giveaway if it becomes unsafe.

Nothing in this clause excludes bodily-injury liability that cannot legally be waived.

 

 

50. PHOTOGRAPHY, VIDEO & AUDIO RECORDING

ANATHA IS A PHOTOGRAPHED AND RECORDED EVENT.

Participants understand that photography, filming and audio recording may take place throughout the Festival.

This may include:

  • crowd footage;

  • stage footage;

  • workshop footage;

  • photographs;

  • event recap videos;

  • interviews;

  • documentary footage;

  • social-media production;

  • television;

  • streaming;

  • promotional recording; and

  • press coverage.

 

 

51. MEDIA CONSENT

Subject to applicable Québec law, by purchasing a ticket and attending the Festival, the Participant consents to being photographed, filmed and audio recorded as part of Festival activities and coverage.

The Participant authorizes Anatha and its authorized media, production and marketing partners to use Festival media in which the Participant appears for:

  • Festival coverage;

  • recap content;

  • social media;

  • Anatha websites;

  • email marketing;

  • future Festival promotion;

  • future ticket sales;

  • advertising;

  • trailers;

  • documentary content;

  • television;

  • streaming;

  • press;

  • sponsorship materials; and

  • archives.

Media may be:

  • edited;

  • cropped;

  • reformatted;

  • combined with other material; and

  • distributed through different platforms.

No additional compensation is owed merely because a Participant ordinarily or incidentally appears in general Festival coverage, subject to applicable law.

 

 

52. SPECIFIC COMMERCIAL FEATURES OR ENDORSEMENTS

General Festival recording is distinct from deliberately selecting a specific individual as the principal subject of a separate staged endorsement or unrelated commercial advertisement.

Anatha may obtain additional consent where required by applicable law for such a use.

 

 

53. PARTICIPANT RECORDING OF OTHERS

Official Festival recording does not authorize Participants to harass others with cameras or invade areas where there is a reasonable expectation of privacy.

Recording is prohibited in places such as:

  • bathrooms;

  • changing areas; and

  • other private areas.

Professional or commercial filming may require separate authorization.

 

 

54. WASTE & PACK-IN/PACK-OUT RESPONSIBILITY

Anatha encourages environmentally responsible participation.

Participants should minimize unnecessary waste.

Participants must use designated waste and recycling systems where available.

Participants should not abandon:

  • tents;

  • chairs;

  • coolers;

  • bottles;

  • food;

  • packaging;

  • clothing;

  • camping equipment;

  • cigarette butts; or

  • other property.

Where appropriate:

PACK IT IN — PACK IT OUT.

 

 

55. ENVIRONMENTAL PROTECTION

Participants must not intentionally:

  • damage trees;

  • damage vegetation;

  • disturb wildlife;

  • remove protected natural material;

  • dump waste;

  • dump liquids;

  • damage shoreline areas;

  • vandalize RécréoParc infrastructure; or

  • otherwise damage the site.

 

 

56. GLASS, SHARP OBJECTS & OTHER HAZARDS

Participants must comply with any restrictions concerning:

  • glass;

  • sharp objects;

  • hazardous tools; or

  • dangerous materials.

Broken glass, exposed metal and similar hazards should be immediately reported.

 

 

57. TEMPORARY STRUCTURES

Participants may not climb, enter or interfere with:

  • lighting towers;

  • stage supports;

  • fencing;

  • temporary structures;

  • electrical installations;

  • generators;

  • barriers; or

  • infrastructure not intended for public access.

 

 

58. CHILDREN & MINORS

Parents and guardians remain responsible for supervising minors in their care.

Children must not be left unattended where reasonable supervision is required.

Parents are encouraged to:

  • establish a meeting location;

  • ensure children know who is responsible for them; and

  • immediately report a missing child to security or staff.

 

 

59. EMERGENCY EVACUATION & SHELTER ORDERS

Anatha may reasonably direct Participants to:

  • evacuate;

  • shelter in place;

  • leave a stage area;

  • avoid a particular sector;

  • move to another location; or

  • temporarily suspend activities

because of:

  • lightning;

  • weather;

  • fire;

  • crowd safety;

  • a medical emergency;

  • a security concern;

  • governmental instructions; or

  • another emergency.

Participants must promptly comply with emergency directions.

A temporary safety interruption does not automatically constitute cancellation of the Festival.

 

 

60. EMERGENCY ACCESS

Participants must keep clear:

  • fire lanes;

  • ambulance routes;

  • emergency exits;

  • evacuation corridors;

  • police access;

  • backstage emergency routes; and

  • security corridors.

 

 

61. LOST, SUSPICIOUS OR UNATTENDED ITEMS

Participants should not leave bags or packages unattended.

An unattended or suspicious item may be:

  • inspected;

  • moved;

  • isolated;

  • referred to security;

  • referred to police; or

  • otherwise handled as reasonably necessary for safety.

 

 

62. WRISTBANDS, CREDENTIALS & FRAUD

Participants may not:

  • counterfeit a ticket;

  • duplicate a QR code;

  • alter credentials;

  • tamper with wristbands;

  • unlawfully transfer credentials;

  • enter using fraudulent credentials; or

  • assist another person in gaining unauthorized entry.

Fraudulent admission may result in immediate removal without automatic refund and may be reported to authorities.

 

 

63. NO GUARANTEE OF EVERY SERVICE OR AMENITY

Anatha does not guarantee uninterrupted access to:

  • every stage;

  • every artist;

  • every workshop;

  • every vendor;

  • every menu item;

  • seating;

  • cellular service;

  • internet access;

  • charging;

  • parking;

  • every amenity; or

  • every advertised feature.

Temporary restrictions may result from:

  • capacity;

  • crowd control;

  • weather;

  • safety;

  • technical issues; or

  • operational requirements.

 

 

64. THIRD-PARTY TRANSPORTATION

Anatha does not control independent:

  • taxis;

  • rideshare services;

  • private vehicles;

  • public transportation;

  • third-party shuttles;

  • marine traffic;

  • public roads; or

  • RécréoParc parking operations.

Participants remain responsible for safe transportation arrangements.

 

 

65. REPORTING SAFETY CONCERNS

Participants are encouraged to immediately report:

  • fires;

  • medical emergencies;

  • suspected drugging;

  • sexual misconduct;

  • violence;

  • dangerous intoxication;

  • unauthorized water entry;

  • equipment tampering;

  • suspicious packages;

  • missing children;

  • broken glass;

  • unsafe structures; or

  • another material hazard.

 

 

66. REMOVAL FROM THE FESTIVAL

Anatha may refuse entry or remove a Participant where reasonably necessary for safety, compliance or protection of the Festival.

Examples include:

  • violence;

  • sexual misconduct;

  • harassment;

  • illegal drugs;

  • dangerous intoxication;

  • prohibited weapons;

  • unauthorized water access;

  • unauthorized fire;

  • equipment tampering;

  • backstage intrusion;

  • vandalism;

  • theft;

  • fraudulent credentials;

  • intentional violation of venue rules; or

  • repeated refusal to follow reasonable safety instructions.

 

 

67. BANNING FROM FUTURE EVENTS

Serious misconduct may result in a Participant being prohibited from attending future Anatha events.

This may apply particularly to:

  • assault;

  • sexual misconduct;

  • intentional drugging;

  • theft;

  • substantial vandalism;

  • intentional equipment damage;

  • dangerous fire violations; or

  • repeated serious violations.

 

 

68. RESPONSIBILITY FOR PROPERTY DAMAGE

A Participant may be held legally responsible for damage they intentionally or wrongfully cause to:

  • RécréoParc property;

  • Anatha property;

  • artist equipment;

  • vendor property;

  • production equipment;

  • vehicles;

  • vegetation;

  • stages;

  • tents;

  • bathrooms; or

  • another Participant’s property.

 

 

69. INDEMNIFICATION FOR PARTICIPANT’S OWN CONDUCT

To the fullest extent permitted by applicable Québec law, the Participant agrees to indemnify and hold harmless Anatha and its directors, officers, employees and authorized representatives from third-party claims, damages, penalties, costs and reasonable legal expenses to the extent directly caused by that Participant’s own intentional, unlawful or otherwise legally wrongful conduct, including:

  • violation of these Conditions;

  • unlawful activity;

  • property damage;

  • vandalism;

  • theft;

  • assault;

  • harassment;

  • unauthorized fire;

  • unauthorized equipment use;

  • deliberate interference with Festival operations;

  • violation of applicable RécréoParc rules; or

  • another legally actionable act attributable to the Participant.

This clause is not intended to require the Participant to indemnify Anatha for liability arising independently from Anatha’s own fault where doing so is prohibited by law.

 

 

70. SPECIAL INDEMNITY FOR RÉCRÉOPARC CLAIMS CAUSED BY A PARTICIPANT

The Participant understands that Anatha has its own obligations toward RécréoParc.

To the fullest extent permitted by law, where:

  1. a Participant violates a RécréoParc rule or causes damage;

  2. the violation or damage is attributable to that Participant;

  3. RécréoParc consequently makes a lawful claim against Anatha; and

  4. the claimed amount is directly attributable to the Participant’s conduct,

the Participant agrees to indemnify Anatha for legally recoverable:

  • repair costs;

  • cleanup costs;

  • property damage;

  • charges;

  • penalties;

  • third-party claims; and

  • reasonable related legal costs

directly caused by the Participant.

Examples may include:

  • unauthorized fires;

  • vandalism;

  • destruction of vegetation;

  • damaged equipment;

  • unauthorized access;

  • prohibited vehicle conduct; or

  • other direct venue damage.

 

 

71. THIRD-PARTY WRONGDOING

Attendance at the Festival does not make Anatha the insurer of every independent person’s conduct.

To the extent permitted by applicable law, Anatha is not automatically responsible merely because:

  • another Participant;

  • a vendor;

  • an artist;

  • an independent contractor; or

  • another third party

commits an unlawful or wrongful act.

Nothing in this clause excludes liability based upon Anatha’s own acts or omissions where applicable law imposes such liability.

 

 

72. LIMITS ON LIABILITY LANGUAGE UNDER QUÉBEC LAW

Nothing in this Agreement shall be interpreted as excluding or limiting Anatha’s liability where such exclusion is prohibited.

In particular, Article 1474 of the Civil Code of Québec provides that liability may not be excluded or limited for bodily or moral injury and restricts exclusions concerning intentional or gross fault.

The purpose of this Agreement is therefore to:

  • provide clear notice of risk;

  • establish reasonable conduct rules;

  • document informed participation;

  • establish responsibility for the Participant’s own conduct; and

  • preserve lawful contractual protections,

rather than purporting to waive rights that cannot legally be waived.

 

 

73. LANGUAGE OF THE FESTIVAL

Anatha Festival operates predominantly in French.

Certain staff, volunteers, artists, vendors or service providers may also communicate in English.

Anatha does not guarantee that every:

  • artist;

  • vendor;

  • volunteer;

  • workshop leader; or

  • staff member

is bilingual.

Participants requiring clarification of an important safety rule or Festival instruction should request assistance.

 

 

74. FRENCH & ENGLISH VERSIONS OF THIS AGREEMENT

This Agreement is intended to be made available in French and English.

For a standard-form contract subject to Québec’s Charter of the French Language, the French version must generally be remitted before the adhering party expressly chooses to contract in another language.

Accordingly, where required:

  1. the French version will be made available first;

  2. the Participant may then expressly choose the English version; and

  3. no additional charge will be imposed for the French version.

 

 

75. ENGLISH-LANGUAGE SELECTION

A Participant electing to contract in English confirms that:

  • the French version was made available as required by law;

  • they expressly chose the English version;

  • they can read and understand the English version sufficiently to understand its material terms; and

  • they had an opportunity to review the Agreement before purchasing.

 

 

76. REQUEST FOR TRANSLATION OR LANGUAGE ASSISTANCE

A prospective Participant who does not sufficiently understand the French or English version should contact Anatha before completing the purchase.

Where reasonably possible, Anatha may assist the prospective Participant in obtaining a translation or clarification.

A Participant should not complete the purchase until they understand the material conditions of attendance.

Nothing in this clause limits a mandatory language right under Québec law.

 

 

77. NO GUARANTEE OF TRANSLATION DURING EVERY FESTIVAL ACTIVITY

The availability of ticket terms in French and English does not guarantee:

  • bilingual performances;

  • bilingual workshops;

  • simultaneous interpretation;

  • bilingual vendor service; or

  • translation of every conversation at the Festival.

 

 

78. SEVERABILITY

If any provision of this Agreement is held invalid, illegal or unenforceable, it shall be interpreted, limited or disregarded only to the minimum extent required by law.

The remaining provisions shall continue to apply to the extent legally permissible.

 

 

79. GOVERNING LAW

This Agreement is governed by the laws of the Province of Québec and applicable federal laws of Canada.

 

 

80. CONSUMER RIGHTS PREVAIL

Nothing in this Agreement removes any mandatory consumer right that cannot legally be waived.

Consumer and adhesion contracts may also be subject to rules concerning abusive or incomprehensible clauses.

 

 

81. PARTICIPANT CONFIRMATION

By purchasing or using an Anatha ticket and entering the Festival, the Participant confirms that they understand and agree that:

  • Anatha is an outdoor large-scale Festival;

  • attendance involves inherent risks;

  • programming and artists may change;

  • individual artist changes do not automatically create refund rights;

  • force majeure or safety circumstances may require substantial event changes;

  • RécréoParc rules must be respected;

  • parking is separate from ordinary Festival admission where applicable;

  • drawbridge and marine traffic may cause significant delays;

  • Participants are encouraged to shut off idling vehicles when safely possible;

  • personal belongings remain the Participant’s responsibility;

  • security screening may be required;

  • refusal of required screening may result in denied entry without an automatic refund;

  • prohibited items must not be brought onto Festival grounds;

  • unauthorized fires are prohibited;

  • unauthorized swimming or river entry is prohibited;

  • the separate RécréoParc Beach is not included with Anatha admission;

  • illegal drugs are prohibited;

  • dangerous public intoxication is prohibited;

  • sexual assault and harassment are prohibited;

  • vendors are generally independent third parties;

  • Participants should communicate allergies directly to food vendors;

  • intentional food or drink adulteration is prohibited;

  • tattoos and body-art transactions are directly with the provider;

  • backstage and technical areas are restricted;

  • musical and production equipment must not be touched without authorization;

  • giveaways may occur from Festival stages;

  • the Festival is photographed, filmed and audio recorded;

  • Festival recordings may be used for future marketing subject to applicable law;

  • Participants must protect the site and remove their waste;

  • Participants are responsible for damage and wrongful conduct they personally cause; and

  • mandatory Québec legal rights remain unaffected.

 

 

82. REQUIRED CHECKOUT ACCEPTANCE — MASTER TERMS

Before completing payment, the purchaser should be required to check a box substantially stating:

“I have read and agree to the Anatha Festival Master Ticket Holder Agreement, Conditions of Entry, Acknowledgement of Risk, Media Consent & Indemnification. I understand that Festival admission is conditional on compliance with Anatha and RécréoParc safety rules, that artists and programming may change, that security screening may be required, and that I may be responsible for damage or third-party claims directly caused by my own wrongful conduct.”

83. REQUIRED LANGUAGE SELECTION — ENGLISH

Where the purchaser elects English after receiving or being provided the French version as legally required:

“The French version of this Agreement has been made available to me. I expressly choose to contract in English and confirm that I am able to read and understand the English version.”

 

 

84. MEDIA ACKNOWLEDGEMENT

A separate visible acknowledgement is recommended:

“I understand that Anatha Festival is photographed, filmed and audio recorded. Subject to applicable law, I consent to Anatha’s use of Festival recordings in which I appear for event coverage, archives, social media, advertising, marketing and promotion of current and future Anatha events.”

 

 

85. SECURITY ACKNOWLEDGEMENT

A separate visible acknowledgement may state:

“I understand that reasonable security screening of bags and belongings is a condition of Festival entry. I consent to such screening. If I decline required screening, I understand that I may be denied entry or re-entry and that such refusal does not, by itself, entitle me to a refund except where required by applicable law.”

 

 

86. SHORT TICKET-PAGE NOTICE

IMPORTANT FESTIVAL CONDITIONS

Anatha is a live outdoor Festival.

Artists, programming, schedules, vendors and certain Festival details are subject to change.

The cancellation or substitution of one or more individual artists does not constitute cancellation of the Festival and does not, by itself, entitle the purchaser to a refund.

Unforeseeable circumstances may require changes to the Festival date, venue, hours, programming or operation.

Admission is subject to Anatha and RécréoParc rules and reasonable security screening.

Tickets are final sale except where Anatha elects otherwise or applicable law requires otherwise.

 

 

87. ARRIVAL NOTICE — BRIDGE & PARKING

ARRIVING BY CAR

Expect delays.

Access to RécréoParc may be temporarily interrupted by St. Lawrence Seaway vessel traffic and operation of the lift bridge.

Participants should arrive well in advance of performances or workshops they wish to attend.

During extended periods when your vehicle is fully stationary, please turn your engine off whenever safe and practical.

Parking is administered separately through RécréoParc where applicable.

 

 

88. WATERFRONT SIGNAGE

NO SWIMMING FROM ANATHA FESTIVAL GROUNDS

No swimming.
No wading.
No jumping or diving.
No unauthorized watercraft.

RécréoParc operates a separate paid Beach, subject to its own admission, hours and rules.

Beach access is not included with an Anatha ticket.

 

 

89. FIRE SIGNAGE

NO UNAUTHORIZED FIRE OR OPEN FLAME

No campfires.
No unauthorized BBQs.
No candles or torches.
No fire performance.
No fireworks.
No pyrotechnics.

Prior written authorization is required where such activity is permitted.

 

 

90. DRUG & CONSENT SIGNAGE

ZERO TOLERANCE

No illegal drugs.
No drug distribution.
No intentional drink or food tampering.
No sexual assault.
No unwanted sexual contact.
No violence or harassment.

Report safety concerns immediately to Festival security or medical personnel.
